Legal Advice Forms & Strategies

When you and your spouse agree to dissolve the marriage, it can become quite painless, if you can amicably decide who gets what assets and debts, and you can file your own divorce with many of the legal divorce forms you can find online. This is particularly easy if you have no children and limited assets and debt. This is a no contest or no fault divorce.

Most costly divorce settlements are due to spitefulness and bitterness. These kinds of divorce are a waste of energy and your money, and can often escalate the problems which drove you to divorce ion the first place.

Once this bad energy is removed, where possible, it can be a much more affordable affair, and negotiations can begin without the need for expensive lawyers, you could even file your own legal divorce forms, as the divorce courts do not require an attorney for the actual divorce.

Depending on the things you have accumulated, it can be pretty clear-cut as to who keeps what car, stays in the house or sells the house, and gets which personal items. Personal items are normally the hardest to divide, and you need to ask yourself, it this something I can live without.

If you are fair, give your spouse the items you know that they will want and it will be easy to get through this part.

There are many sites which help with the formal division of property, and they can have these divisions written into the divorce. Plus they usually have all 50 states legal divorce forms.

Car and property still may have debts against them when you come to divorce. So you both need to decide on who gets the asset, and the debt, or whether an item should be sold and the equity divided between you equally.

Once you have agreed on the division of property, it is time to draw up your actual legal divorce forms, they are normally listed State-specific, and then file them at the courthouse with the applicable fees.

Courthouse employees will not tell you what to do or how to file, as they cannot give legal advice, but usually there will be instructions online outlining the sequence.

A date will be set, and either one or both of you will need to go before the judge. If he is happy with the agreement you have both outlined, he will sign off, and your divorce will be granted. You'll end up saving a ton of money in legal fees, and you may even remain friends.
